EverAgent provides an AI-powered receptionist service for home service businesses. Our service answers phone calls, Facebook Messenger messages, and Instagram DMs on your behalf, qualifying leads and capturing essential customer information.

2. Account Registration

To use EverAgent, you must:

• Provide accurate and complete information during registration
• Be at least 18 years old or have legal authority to bind your business
• Keep your account credentials secure
• Notify us immediately of any unauthorized access

3. Acceptable Use

You agree to use EverAgent only for lawful business purposes. You may not:

• Use the service for any illegal or fraudulent activity
• Misrepresent your business or services to callers
• Use the service to harass, spam, or deceive customers
• Attempt to reverse-engineer or copy our technology
• Interfere with the operation of our service

4. Pricing and Payment

EverAgent operates on a monthly subscription model:

• Pricing is as displayed on our website at the time of signup
• Subscriptions renew automatically each month
• You may cancel at any time; cancellation takes effect at the end of your billing period
• We do not offer refunds for partial months
• Prices may change with 30 days notice

5. Service Availability

We strive to provide 24/7 service, but we cannot guarantee uninterrupted availability. We are not liable for:

• Temporary service outages for maintenance or updates
• Issues caused by third-party services (phone carriers, social media platforms, CRMs)
• Circumstances beyond our reasonable control

6. Data and Privacy

Your use of EverAgent is also governed by our Privacy Policy. By using our service, you acknowledge that:

• Calls and messages handled by EverAgent are recorded and transcribed
• Lead data is stored and transmitted to your connected CRM
• You are responsible for informing your customers about AI-assisted communication where required by law

7. Intellectual Property

EverAgent, including our AI technology, branding, and content, is our intellectual property. You may not copy, modify, or distribute our technology without permission.

8. Limitation of Liability

To the maximum extent permitted by law:

• EverAgent is provided "as is" without warranties of any kind
• We are not liable for lost leads, missed calls, or business losses
• Our total liability is limited to the fees you paid in the previous 3 months
• We are not liable for indirect, incidental, or consequential damages

9. Indemnification

You agree to indemnify and hold EverAgent harmless from any claims, damages, or expenses arising from your use of the service or violation of these terms.

10. Termination

Either party may terminate this agreement:

• You may cancel your subscription at any time through your account
• We may suspend or terminate accounts that violate these terms
• Upon termination, your access to the service and stored data will end

11. Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be communicated via email or through our service. Continued use after changes constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the Province of New Brunswick, Canada. Any disputes will be resolved in the courts of New Brunswick.
